These terms govern all freight forwarding services provided by Big Five Shipping ("we", "us") between the United States and Kenya. By tendering cargo to us, requesting a quote, or using our website, you ("the customer") agree to these terms.
We act as a freight forwarder: we receive, consolidate, and arrange transport of your cargo by air or sea from the USA to Kenya, including customs clearance support and optional door-to-door delivery. We are not the airline, shipping line, or customs authority, and transit is subject to their schedules and requirements.
Insurance is mandatory on all shipments: 2% of declared value for general goods and 5% for electronics. You are responsible for declaring the accurate value of your cargo. Claims for insured loss or damage are settled up to the declared value, subject to the insurer's terms.
Transit times (typically 7–14 business days by air; 10–14 weeks by sea) are estimates, not guarantees. Delays can occur due to carrier schedules, weather, port congestion, or customs inspection, and do not entitle the customer to compensation or refunds.
Import duties, taxes, and levies assessed by Kenyan authorities are the customer's responsibility and are not included in our freight charges unless expressly stated. You are responsible for the accuracy of all cargo descriptions and declared values. Cargo may be inspected by customs in either country.
You must not ship: illegal goods, narcotics, weapons, ammunition, explosives, flammable or hazardous materials, perishables (unless agreed in advance), counterfeit goods, currency, or any item prohibited by US export or Kenyan import law. We may refuse, hold, or surrender to authorities any prohibited cargo, and the customer bears all resulting costs and liability.
Cargo must be adequately packed for international transport and clearly labeled with your name, shipping code, and phone number as instructed. We are not liable for damage resulting from inadequate packing of goods we did not pack.
Cargo not collected or deliverable within 60 days of arrival in Kenya, after reasonable attempts to contact you, may be subject to storage fees or disposal to recover costs.
Loss or damage must be reported to us in writing within 7 days of delivery (or expected delivery). Claims are handled through the mandatory insurance described in section 3. Our own liability, where insurance does not apply, is limited to the freight charges paid for the affected shipment.
To the maximum extent permitted by law, we are not liable for indirect or consequential losses (lost profits, missed opportunities, replacement costs beyond declared value) arising from delay, loss, or damage. Nothing in these terms excludes liability that cannot be excluded by law.
Portal accounts are personal to you. Keep your credentials secure; you are responsible for activity under your account. We may suspend accounts used fraudulently or abusively.
These terms are governed by the laws of the State of Washington, USA, for shipments originating in the USA, without prejudice to mandatory consumer protections that apply in the customer's country of residence.
We may update these terms; the version published on this page at the time you tender cargo applies to that shipment.
